Right to Work


By law, employers must verify that all candidates have the right to work in the UK. They can do this in one of three ways:

1. Conducting a manual, in-person document check;

2. Completing a digital right to work checks using an Identity Service Provider (IDSP) such as Credas;

3. Using the Home Office online system with share codes.

As an IDSP, Credas can assist you in completing digital right to work checks and obtain share codes for you to use on the Home Office online system.

Using Credas for right to work

To meet the UK regulations for digital right to works check via an IDSP, the individual will be asked to confirm their personal details, and capture one of the following:

  • British passport;
  • Irish passport or passport card;
  • Share code.

The individual will also be asked to perform a liveness check to ensure they are live and present when completing the check, and in the case a passport is captured, the liveness check will be compared against the photograph on the document to ensure it is for the same individual.

We also offer a Right to work journey that includes an UK residential check, if required.

British/Irish Passport

To meet the guidelines for right to work checks carried out digitally using an IDSP, British/Irish citizens must present their British/Irish passport. If the individual does not have one of these documents, they will be unable to complete Credas' right to work check. If you wish for an individual to submit a alternative documents, such as a birth certificate and national insurance number, you will be asked to sign a waiver acknowledging it will not provide you with a statutory excuse. If you wish to enable this function, called the Employee Identity Check journey, please contact our team here

Please note, in the instance of obtaining a birth certification/national insurance number, Credas is unable to verify these, and they will need your manual review.

Share code

In the instance that the individual has uploaded their share code, this share code will be presented to you within the Credas portal for you to then obtain the settled status document from the Home Office's online system, you can read more on how to do this here.

Where a share code is provided, an identity document will not be requested and Credas will not obtain the settled status document for you. Where you wish to deviate from the compliant specification, by asking that we capture an overseas passport alongside a share code and/or you would like Credas to obtain the settled status document for you, we are able to provide this to you upon you signing a waiver. How do you send a right to work check to an individual?

To send a right to work check to an individual, please follow the guidance here and select a right to work journey. 

Right to work results

Once a right to work check has been completed, you will see the below checks appear to you:

  • Liveness check;
  • Identity Document check (if the individual is using a British/Irish passport);
  • Digital Identity Trust Framework;
  • Right to work tab (if the individual entered their share code, you will be able to find it here);
  • If you issued a Right to work + address journey, you will also see a UK Address & Mortality check appear and/or a proof of address document.

FAQs

Can you add comments on the record for your audit trail?

Yes, you can add comments to an individuals profile on Credas by following the steps here. In addition to this, if you update any results you will be asked to add a comment and this will also appear on the individuals profile and process PDF.

Does Credas notify you when the settled status or passport is about to expire?

No, Credas will not notify you when the share code or passport is going to expire, you will need to keep records of this yourself. If you wish to complete another right to work check on an individual, you can send them a new journey by following the steps here.

How do you download a record of the right to work check?

You can download a PDF report of the right to work check, including any remediation notes from yourselves, by downloading a 'process' PDF by following the steps here.

Do you still need to complete an impostor check?

Yes, if you are using an IDSP to carry out right to work checks you still need to complete an impostor check. The IDSP is verifying that the identity document is genuine and belongs to a real person, it does not confirm that the person who submitted the document is the same person you are hiring.

What is the employer's responsibility when using an IDSP?

Even when using an IDSP, it is the employers responsibility to remain compliant with right to work regulations, including verifying that the individual verified by the IDSP is the candidate.
